Legal Routes, Preservation and Redress
Sources checked 31 October 2026. General information. Other jurisdictions require separate advice.
Define the objective before the procedure
Obtaining records, preventing a threatened act, determining liability and receiving payment are different objectives. They may involve different decision makers and evidentiary requirements. A coherent strategy asks what a proposed step can achieve and which further steps would still be needed.
The discussion below is an overview of United States federal procedure and selected government processes. It is not a filing guide. State law, local rules, substantive rights and foreign procedures require separate review.
Disclosure and interim relief in civil proceedings
The Federal Rules of Civil Procedure address discovery and production in Rules 26, 34 and 45. Rule 65 addresses injunctions and restraining orders, with distinct notice, evidentiary and security requirements. An urgent request is not granted merely because assets are digital or a loss is alleged. See the current official Federal Rules of Civil Procedure.
A preservation request is also distinct from a court order compelling disclosure or restraining conduct. Counsel must assess the available legal basis, forum and appropriate scope. The practical ability of the recipient to act is a separate question.
Government forfeiture and victim compensation
Government seizure and forfeiture are not powers of a private law firm. A civil claim brought by a client should not be conflated with a government asset forfeiture proceeding.
DOJ distinguishes remission, a discretionary process involving finally forfeited assets and qualifying victims, from court-ordered restitution. It states that filing a remission petition does not require a fee or an attorney, although a person may choose representation. Availability and distribution depend on the actual proceeding. See DOJ: Compensating Victims with Forfeited Assets.
Recovery of money is a separate practical question
An entitlement or favorable decision does not alone establish that an identifiable asset is available to satisfy it. Costs, competing claims, asset location and enforcement requirements may affect the value of a proposed route. Counsel should explain those dependencies when discussing strategy.
Filing an IC3 report is not a freeze order, a civil judgment or approval of a private firm. Reporting can contribute information to agencies while other legal options are assessed. Do not treat an acknowledgement or reference number as evidence that funds have been secured.
Questions to raise in a consultation
Identify any existing proceedings, official notices and known deadlines. Explain the outcome sought and the records available. Ask which work is included in the proposed engagement, what remains with another adviser or authority and when costs or strategy will be reviewed.
